The PWR! Virtual Experience Terms of Use Agreement (“Terms”) is made between NeuroFit Networks Inc. dba Parkinson Wellness Recovery | PWR!  (“NFN”, “we”, “us”, or “our”) and you, the user (“you” or “your”).  These Terms govern NFN-owned websites, video content, and materials (collectively, the “Services”), accessed via https://www.exerciseforbrainchange.org/

By using the Services, including any and all content and functionality, you accept and agree to be bound by the Terms, which may change at any time and in the sole discretion of NFN.

License to Use

NFN grants users of the PWR! Virtual Experience a limited license to access and use the Services for user’s personal, non-commercial use only. Any copying, broadcasting, redistribution, retransmission, or publication of any material contained on the website is strictly prohibited.

This license shall automatically terminate if you violate any of these Terms and may be terminated by NFN at any time. Upon termination, you agree to destroy any downloaded materials in your possession whether in electronic or printed form.

Copyright
All content on the website, including, without limitation, the “NFN” and “PWR!” names, trademarks, design, text, graphics, pictures, sound files, video files, audio-visual files, and other files, and the selection and arrangement thereof and all proprietary rights therein are the sole and exclusive property of NFN.

Video Content
The PWR! Virtual Experience offers the following options for purchasing video content: subscriptions and packages. You may hold a subscription and package(s) at the same time. You can find details of your purchased content at any time by signing in and accessing My Account.

Subscription

Your subscription will include access to pre-recorded video content and live virtual exercise classes. Your subscription will automatically renew on an ongoing basis each month until you cancel it in accordance with these Terms. We may offer free trials or discounted subscriptions. Your paid subscription begins when the free trial period ends, and you agree to pay the full monthly or annual fee at that time. If we provide a discount for the first subscription period, you agree to pay the discounted fee; upon renewal, you agree to pay the full fee.

From time to time, NFN may elect to change the price of your subscription. If and when a price change occurs, NFN will provide a minimum of 30 days’ notice during which you may opt to change or cancel your membership subscription.

You may cancel your subscription at any time through your My Account page. To do so:

Go to My Account Page.
Click My Subscription Tab.
Cancel Subscription from Actions.

Once submitted, cancellation may take up to ten (10) business days to take effect. All subscriptions are non-refundable. Once the subscription payment has been processed, it is non-refundable.

 

Package

Purchase of an individual package will include access to a set number of pre-recorded videos.

You must submit a one-time, non-refundable payment to purchase a package. Your package will include use of specified content for three (3) months from the date of purchase. To use the package after the end of the three-month period, you will need to purchase the package again.

 

There is no limit to the number of packages you may purchase; however, each package is its own unique product and must be purchased separately. Once the package is purchased, it is non-refundable.

Returns/Refunds

If an exception occurs where a refund is necessary, contact us. Your correspondence must include the original receipt of the purchase and the reason for requesting a change or refund. On a case-by-case basis, we will issue refunds to your original form of payment for items returned to us within 30 days of the original purchase.

Shipping/Delivery
Items ship within 2 days of purchase. For First Class shipping, please allow 5-7 business days from the time of shipment for delivery. For Priority Shipping, item(s) should arrive within 2-3 business days from the time of shipment. Please contact us if you have additional questions.

Third-Party Links, Products, and Services
From time to time, parties other than NFN may offer and provide products and services on or through the website. NFN does not assume any responsibility or liability for any third parties' actions, products, and content. You should carefully review their terms of use, privacy statements, and other policies.

Governing Law
These Terms of Use are governed by the laws of Arizona. Users irrevocably and unconditionally consent and submit to the exclusive jurisdiction of the courts of Pima County, Arizona, over any suit, action, or proceeding arising from this Agreement.

NFN's failure to insist upon or enforce strict performance of any provision of these terms shall not be construed as a waiver of any provision or right. It shall not prevent NFN from subsequently requiring strict compliance by any person with such terms.

Severability
If any provision in these terms shall be deemed unlawful, void, or unenforceable for any reason, then that provision shall be deemed severable from the others and shall not affect the validity and enforceability of any remaining provisions.
